Suit Aims to Protect Winchester Mystery House's Trademarks over "Haunting of Winchester" DVD Release.
Los Angeles-Long Beach, CA (1888PressRelease) December 28, 2009 - SAN JOSE – Winchester Mystery House, LLC, today announced that it has filed a lawsuit in the California Superior Court for the County of Santa Clara, against Los Angeles-based entertainment production company and distributor, The Asylum, Inc. (Case No. 1-09-CV-155403).
The Winchester Mystery House, LLC's complaint alleges claims for trademark infringement and unfair competition by The Asylum for its unauthorized use of Winchester Mystery House™ trademarks, in connection with The Asylum’s recent October 2009 DVD release, currently entitled “Haunting of Winchester House.” The complaint seeks redress for the misleading impression that the DVD product is tied to the world famous San Jose landmark and tourist attraction. The lawsuit seeks injunctive relief, as well as compensatory and punitive damages.
