Vietnamese Regulations on Formaldehyde and Azo Dyes in Textile Products Came into Effect on January 1, 2019
Vietnam’s regulation requirements for formaldehyde and azo dye use in textile products came into effect on January 1, 2019, following a delay from May 2018.
- (1888PressRelease) January 09, 2019 - Since January 1, 2019, textile products sold in Vietnam must comply with the National Technical Regulations regarding formaldehyde and aromatic amines derived from azo colorants.
The regulation stipulates that the maximum permissible formaldehyde content is:
• 30 mg/kg for textiles for children under 3 years old
• 75 mg/kg for textiles with direct skin contact
• 300 mg/kg for products without direct skin contact
For aromatic amines derived from azo colorants, the maximum content level is 30 mg/kg for all textile products.
The regulation also demands that textile products manufactured or imported into Vietnam must conform to rules concerning conformity marks at the point of sale and provide a conformity certificate. This can be done by self-declaration or through an appointed certifying organization.
Responsibility for appointing certifying or testing organizations rests with the Science and Technology Department of Ministry of Industry and Trade. The organization and direction of market management branches in the provinces is controlled by the General Department of Market Management, who inspect, control and handle violations of the regulations.
Violations of the regulation can result in financial penalties – 5 to 320 million Vietnamese Dong or 2-3 multiples of goods value. This is according to Decree No. 119/2017/ND-CP dated November 1, 2017.
The January 1, 2019 date was an amended date after the Vietnam Ministry of Industry and Trade (MOIT) issued Circular No. 07/2018/TT-BCT in April 2018. This circular revised the original enforcement date of May 1, 2018, as noted in Circular No. 21/2017/TT-BCT dated October 23, 2017.
