US State of Colorado Regulates PFAS Chemicals in Firefighting Foams and Equipment

Colorado approves measures to regulate PFAS chemicals in firefighting foams and FPPE. Implementation starts on August 2, 2019. End Quote

(1888PressRelease) August 15, 2019 - The governor of the US state of Colorado has signed into law measures to regulate perfluoroalkyl and polyfluoroalkyl substances (PFAS chemicals) in firefighting foams and firefighting personal protective equipment (FPPE).

The bill, HB19-1279, was signed into law on June 3, 2019. It contains several important provisions, including:
• Prohibiting Class B firefighting foams with intentionally added PFAS chemicals and their use for training purposes
• Requiring manufacturers and/or sellers of FPPE to disclose whether the products contain intentionally added PFAS chemicals and the reason for the addition
• Expanding the power of the Colorado Department of Public Health and Environment (CDPHE) to allow it to request certificates of compliance (CoCs) from manufacturers of Class B firefighting foam or FPPE

The requirements relating to FPPE become effective on August 2, 2019. The prohibition on PFAS chemicals in Class B firefighting foams comes into effect on August 2, 2021.
