US CPSC Proposes Mandatory Phthalate Testing Exemption for Certain Plastics
US CPSC has issued an NPR for the exemption of polypropylene (PP), polyethylene (PE), high impact polystyrene (HIPS), and acrylonitrile butadiene styrene (ABS) from third party testing for regulated phthalates content.
- (1888PressRelease) September 13, 2016 - On August 17, 2016, the Consumer Product Safety Commission (CPSC) issued a Notice of Proposed Rulemaking (NPR) relating to the requirement for third party testing for phthalates in specific types of plastic. The CPSC has now given stakeholders a period of 75 days to comment on the proposals before a final rule is made.
Under the Consumer Product Safety Improvement Act of 2008 (CPSIA), manufacturers and importers of childcare articles and certain toys are currently required to use a third-party laboratory to certify their products do not contain certain phthalates: DEHP, DBP, BBP, DINP, DIDP, and DnOP.
By issuing the NPR, the CPSC is seeking to create a new section in the US Code of Federal Regulations, 16 CFR 1308, which will exempt certain types of plastic from these mandatory third party tests. The CPSC has determined that the following types of plastic can be exempted from testing because the plastics are not expected to contain regulated phthalates above the threshold limits.
The NPR proposal relates to:
• Polypropylene (PP)
• Polyethylene (PE)
• High impact polystyrene (HIPS)
• Acrylonitrile butadiene styrene (ABS)
The proposed exemption does not mean the plastics are no longer required to meet the phthalate content requirements.
