US CPSC Issues Final Rule and Phthalate Method for CPSIA Compliance
The US CPSC has published a new method for phthalates and a final rule allowing accredited laboratories two years to update their scope of accreditation.
- (1888PressRelease) February 16, 2018 - The US Consumer Product Safety Commission (CPSC) has issued a new method to test for phthalates and a final rule to allow accredited laboratories a period of two years to update the scope of their accreditation.
In November 2017, the CPSC published a final rule relating to the use of phthalates in toys and childcare articles, and a Notice of Proposed Rulemaking (NPR). The NPR concerned the requirement for CPSC-accredited laboratories to updates to the latest method for phthalates. The NPR referenced draft CPSC-CH-C1001-09.4 (2017), and gave a deadline of January 10, 2018, for comments.
The latest pronouncement was issued by the CPSC on February 1, 2018. It contains a final rule, published in the Federal Register (83 FR 4578), amending the NPR.
The new final rule contains, inter alia, the following provisions:
• Provided the laboratory is already CPSC-accepted for CPSC-CH-1001-09.3 (2010), CPSC will accept testing results to support toy and child care article certifications for the new restrictions for eight phthalates until January 31, 2020 (two years)
• Until laboratories have revised their accreditation scope and listing to CPSC-CH-C1001-09.4 (2018), the following must be stated in test reports to support certification of the restriction of eight phthalates:
o ’16 CFR Part 1307’ and ‘CPSC-CH-C1001-09.3’
• Changes in Test Method CPSC-CH-C001-09.4 (2018) include editorial clarifications, test procedure to clarify the list of eight prohibited phthalates, additions to test equipment and supplies section, and the inclusion of ASTM D8133-17 as one of the acceptable standalone methods for phthalate content certification testing
• The CPSC opened application process for CPSC-CH-C1001-09.4 (2018) on February 1, 2018
Stakeholders should be aware the final rule, relating to CPSC acceptance of third-party laboratories, will become effective on April 25, 2018 – the same as the final rule for eight phthalates
