US CPSC Introduces Testing Exemption for Certain Engineered Wood Products Used in Children's Articles
The CPSC published a final rule on June 22, 2018, exempting certain EWPs from third party testing for specific regulated substances in children’s products. The final rule becomes effective on July 23, 2018.
- (1888PressRelease) July 12, 2018 - The US Consumer Product Safety Commission (CPSC) has exempted some untreated and unfinished engineered wood products (EWPs) used in children’s products from third party testing for specific regulated substances.
The exemption relates to the following EWPs manufactured from virgin wood or pre-consumer wood waste:
• Particleboard (PB)
• Hardwood plywood (HWPW)
• Medium-density fiberboard (MDF)
The CPSC published the final rule in the Federal Register (83 FR 28983) on June 22, 2018. The exemption covers children’s products, toys and childcare articles, and is related to testing for compliance with regulations on lead content, the soluble elements of ASTM F963, and phthalates. Stakeholders should be aware the exemption on phthalates only applies to HWPW if the item does not contain polyvinyl acetate (PVAc) adhesives.
This final rule provides relief to toy and children’s article manufacturers and importers concerning the testing requirements included under the Consumer Product Safety Improvement Act of 2008 (CPSIA). Signed into law in August 2008 by President George W Bush, the CPSIA has sections on child safety, including:
• Section 101 ‘Children’s products containing lead; lead paint rule’
• Section 106 ‘Mandatory toy safety standards’ (ASTM F963)
• Section 108 ‘Prohibition on sale of certain products containing specified phthalates’ (amended by CPSC’s Final Rule of October 2017). This restricts:
o Butylbenzyl (BBP)
o Di-n-butyl (DBP)
o Dicyclohexyl (DCHP)
o Di(2-ethylhexyl) (DEHP)
o Di-n-hexyl (DHEXP (DnHP))
o Diisobutyl (DIBP)
o Diisononyl (DINP)
o Di-n-pentyl (DPENP)
This final rule will come into effect on July 23, 2018. Stakeholders are advised to check they are compliant with the latest requirements under US law.
