Turkey Begins Implementing New Rules for Food Contact Materials and Articles

  • (1888PressRelease) May 17, 2018 - On April 5, 2018, Turkey published two new laws for food contact materials and articles (FCM). These are:

    • Communication Number 2018/9 on rules for active and intelligent materials and articles
    • Regulations on Food Contact Materials and Articles, repealing the Turkish Food Codex Regulations on food contact materials and articles Number 28157 (Repeat 3) of December 29, 2011

    Both pieces of legislation were published under Turkey’s Food Codex in T.C. Resmi Gazete Number 30382.

    Turkey has chosen to follow similar regulations issued in the European Union. For example, Communication Number 2018/9 contains requirements for active and intelligent materials and articles that are similar to those in Regulation (EC) 450/2009, including use of the ‘do not eat’ symbol (Annex 1) and the information required for a declaration of conformity (DoC) (Annex 2).

    Turkey’s new regulations on FCM is similarly based upon language in European regulations – Regulation (EC) 1935/2004. These include provisions for food contact paper and boards, metals and alloys, as well as colorants/dyes for plastics.

    Both pieces of legislation will be implemented in phases, starting with the publishing date of April 5,2018. Important effective dates include:

    • January 1, 2020: effective date for food contact active and intelligent materials and articles that are manufactured, imported, processed or marketed before the publication of Communication Number 2018/9
    • January 1, 2020: food contact paper must comply with requirements in Table 1 in Annex 3 under Turkish Food Codex Number 30382. Until this date, they should comply with specifications in Table 1 of Annex II to Turkish Food Codex Number 28157

    Stakeholders are advised to now check their products comply with the latest laws governing FCM in Turkey and should ensure they are aware of the various compliance dates.
