In April 2017, the U.S. Supreme Court had approved the addition of Rules 902(13) and 902(14) to the Federal Rules of Evidence (FRE). The rules, which became effective in December 2017, have radically changed the process for the collection and admission of electronically stored information (ESI) into evidence at trial. How ESI is collected, reviewed and managed for discovery and investigation has also radically changed. Litigation discovery that used to costs tens of thousands of dollars, if not more, can now be accomplished for a few hundred dollars. Discovery disputes that destroyed credibility and increased litigation costs can now be avoided entirely.
