Stricter Restrictions on Toxics in Packaging Proposed by US TPCH
US TPCH holds a consultation on proposals to strengthen its Model Toxics in Packaging Legislation.
- (1888PressRelease) August 07, 2020 - The US Toxics in Packaging Clearinghouse (TPCH) has opened a consultation on its proposal to regulate perfluoroalkyl and polyfluoroalkyl substances (PFAS) and phthalates in packaging and packaging materials.
Issued on July 9, 2020, the draft update proposes the addition of several provisions to its ‘Model Toxics in Packaging Legislation’, including:
• Prohibiting intentionally added PFAS
• Restricting intentionally added ortho-phthalates (commonly known as phthalates) to no more than 100 ppm (0.01%)
• Laying down the criteria for the identification and prohibition of packaging chemicals of high concern
The TPCH was established in 1992 by the Coalition of Northeastern Governors (CONEG) to promote its model legislation, which restricted to no more than 100 ppm the sum of four intentionally introduced heavy metals:
• Cadmium
• Chromium (VI)
• Lead
• Mercury
The legislation also provided certain derogations to these restrictions and contained requirements that manufacturers/suppliers must provide a certificate of compliance (CoC) to packaging purchasers and, upon request, to state agencies and members of the public.
The legislation has been adopted by 19 US states – California, Connecticut, Florida, Georgia, Illinois, Iowa, Maine, Maryland, Minnesota, Missouri, New Hampshire, New Jersey, New York, Pennsylvania, Rhode Island, Vermont, Virginia, Washington and Wisconsin.
The TPCH will accept comments on its draft update until August 24, 2020.
