  • St. Louis, MO-IL (1888PressRelease) July 25, 2013 - St. Louis family law attorney Jonathan Marks of The Marks Law Firm, L.L.C. appeared on FOX 2 News Tuesday morning to discuss questions regarding which parties are responsible for attorney's fees during a divorce proceeding. Marks was featured during the STLMoms segment hosted by FOX 2 News anchor Margie Ellisor.

    During the segment, Marks introduced the complications that can arise during a divorce case and how several factors such as income, assets, and even conduct before or during the proceedings can affect which party pays attorney's fees.

    "There are instances," Marks said, "depending on the conduct of the spouse either during the marriage or during the litigation, where the court is going to use the attorney's fees to punish that individual if they have used some form of misconduct."

    Marks went on to outline several situations in which attorney's fees can be used as a punishment for one spouse or the other. For example, if one party fabricates allegations in order to gain an advantage in a custody situation, a judge can order that party to pay all attorney's fees.
