Specific Food Contact Plastic Legislation Proposed in Turkey

Turkey has proposed specific legislation covering food contact plastics. If adopted, the provisions will become effective on January 1, 2021. End Quote

(1888PressRelease) January 07, 2019 - The World Trade Organization (WTO) circulated a notification from Turkey in November 2018 announcing its intention to introduce a piece of legislation specific for food contact plastics. The proposed regulations are consistent with many of the provisions for food contact plastics under Regulation (EU) 10/2011 in the European Union.

The proposal, attached to WTO document number 18-7183 and notified under G/SPS/N/TUR/105, would create a new set of requirements for food contact plastics. Provisions include:
• Scope:
o Materials and articles made entirely of plastics
o Plastic multi-layer materials and articles that are held together by adhesives or by other means
o Plastic layers or plastic coatings, forming gaskets in caps and closures, that together with those caps and closures compose a set of two or more layers of different types of material
o Plastic layers in multi-material multi-layer materials and articles
• Exemption - ion exchange resins, rubber and silicones
• Union list of authorized substances - contains more than 1,000 entries
• Overall migration limit (OML) - ≤ 10 mg/dm² otherwise ≤ 60 mg/kg for food contact plastics for infants and young children
• Specific migration limits (SML, Annex 1, Table 1)
Representative examples:
o ≤ 0.3 mg/kg for dibutyl phthalate (DBP)
o ≤ 30 mg/kg for benzylbutyl phthalate (BBP)
o ≤ 1.5 mg/kg for bis(2-ethylhexyl) phthalate (DEHP)
o Not detected for dially phthalate (DAP)
• Specific migration limits (SML, Annex 2)
Heavy Metals:
o ≤ 1 mg/kg (aluminum (Al))
o ≤ 1 mg/kg (barium (Ba))
o ≤ 0.05 mg/kg (cobalt (Co))
o ≤ 5 mg/kg (copper (Cu))
o ≤ 48 mg/kg (iron (Fe))
o ≤ 0.6 mg/kg (lithium (Li))
o ≤ 0.6 mg/kg (manganese (Mn))
o ≤ 0.02 mg/kg (nickel (Ni))
o ≤ 5 mg/kg (zinc (Zn))

In addition, the legislation also contains information on the requirements for a Declaration of Compliance (DoC), must be drawn up in accordance with Annex 3, and supporting documents, which must be made available to business operators and authorities upon request.

The regulation will also include a Fat Reduction Factor (FRF) correction for specific migration in foods containing more than 20% fat.

The WTO document states the new regulation will be adopted and published on February 1, 2019. It will then repeal Regulation number 28710 of July 17, 2013 on food contact plastics.

The provisions of the regulation will then become effective on January 1, 2021.
