SGS Summarizes Revision to Colorado Law on PFAS in Consumer Goods

  • (1888PressRelease) May 30, 2024 - SGS, the world’s leading testing, inspection and certification company, has published SafeGuardS 074.24 to provide interested parties with an overview of Colorado’s updated law covering products containing intentionally added per- and polyfluoroalkyl substances (PFAS).

    HB 22-1345 (Chapter 338) was approved in June 2022. This regulates a variety of consumer goods and added the ‘Perfluoroalkyl and Polyfluoroalkyl Chemicals Consumer Protection Act’ to Title 25 Article 16 Part 6 of the Colorado Revised Statutes (C.R.S. 25-15-601-604).

    SB 24-081 was signed into law on May 1, 2024, revising the PFAS act and making several important changes:
    • Renaming the title to the ‘Perfluoroalkyl and Polyfluoroalkyl Chemicals Protection Act’
    • Prohibiting the installation of artificial turfs that contain intentionally added PFAS
    • Adding several new terms and/or their definitions, including but not limited to the following products:
    o Apparel
    o Automotive cleaning products
    o Cleaning products
    o Cookware
    o Outdoor apparel
    o Outdoor apparel for severe conditions
    o Ski wax
    o Textile articles
    • Repealing the disclosure requirements for PFAS in cookware on January 1, 2026
    • Revoking the 2025 prohibition on outdoor apparel for severe wet conditions containing intentionally added PFAS, unless these products are accompanied by the phrase ‘Made with PFAS Chemicals’, on January 1, 2028, but will prohibit these goods from January 1, 2028
