Issued by the Ministry of Health, Directorial Resolution No. 52-2024-DIGEMID-DG-MINSA came into effect on April 28, 2024. It contains several important provisions, including:
    • Banning the use of bisphenol A (BPA) for manufacturing baby products
    • Restricting the following chemicals in baby items made from vulcanized rubber, silicone or thermoplastic elastomer containing certain materials:
    o N-nitrosamines – less than 0.01 mg/kg (sum)
    o N-nitrosatable substances – less than 0.1 mg/kg (sum)
    • Restricting two groups of phthalates for baby products containing polyvinyl chloride (PVC) materials:
o Diisodecyl phthalate (DIDP), diisonyl phthalate (DINP), di-n-octyl phthalate (DNOP) – no more than 0.1%
o Benzyl butyl phthalate (BBP), dibutyl phthalate (DBP), di(2-ethylhexyl) phthalate (DEHP), diisobutyl phthalate (DIBP) – less than 0.1%

In addition, 19 (soluble) elements are restricted in three categories of baby product. Each category and element has its own requirement.

    The products categories are:
    • Liquid feeding products (bottles, food bags, liquid feeding cups and nipples, among others)
    • Pacifiers (teats or lollipops)
    • Teethers

SGS experts publish SafeGuardS to keep stakeholders informed about regulatory and market changes that could impact their business. SafeGuardS 085.24 provides an overview of the new Peruvian restrictions and includes a table detailing all the requirements for the three product categories and 19 (soluble) elements.

Stakeholders should review SGS’s original SafeGuardS 085.24 for more details.
