  • (1888PressRelease) June 29, 2024 - SGS, the world’s leading testing, inspection and certification company, has published a SafeGuardS detailing the reformulation of chemicals in consumer goods which are regulated under the 1986 California Proposition 65 (Prop 65) legislation.

    Fully titled as the Safe Drinking Water and Toxic Enforcement Act, Prop 65 requires the state to publish a list of chemicals known to cause cancer, birth defects or reproductive harm. The current list includes around 900 chemicals, and businesses have 12 months to comply with the Prop 65 requirements once a chemical has been listed.

    SGS experts publish SafeGuardS to keep stakeholders informed about regulatory and market changes that may impact their ability to trade. SafeGuardS 095.24 contains details of multiple settlements involving a wide variety of products. It includes tables detailing the settlements and reformulations in relation to:
    • Bisphenol A (BPA)
    • One or more phthalates
    • Lead
    • N-nitrosodimethylamine (NDMA)
    • Chromium (VI) compounds
    • Perfluorooctanoic acid (PFOA)

    In many cases, a Prop 65 warning is acceptable as an alternative.

    It should be noted, settlement agreements are only legally binding on named parties, but they do provide an indication of how manufacturers and suppliers should progress when operating in California.
