  • (1888PressRelease) September 11, 2024 - SGS, the world’s leading testing, inspection and certification company, has published a summary of the US CPSC’s notice of rulemaking which adds performance and labeling requirements to existing legislation on battery-operated toys containing button cell or cell batteries.

    Published on August 13, 2024, the notice of proposed rulemaking is intended to address the risk of death or injury to children which is associated with the ingestion of these batteries. The CPSC is proposing an effective date of 180 days after publication of the final rule in the Federal Register, with comments accepted until October 15, 2024.

    An update to ASTM F953 was made in 2023, improving the battery accessibility of toys containing button cell or coin cell batteries by requiring them to undergo use and abuse testing. However, the CPSC does not consider that this addresses all identified hazards or provides protection that is as stringent as the requirements for non-toy consumer products in 16 CFR 1263.

    The proposed new rule will amend 16 CFR 1250, adding a new section to align requirements with both 16 CFR 1263 and IEC 62115 (Electronic Toys – Safety). Additionally, there is a proposed update to 16 CFR 1112 which would also include toys containing button cell or cell batteries in the CPSC’s list of notice of requirements (NORs).
