SGS Publishes Overview of the Ukrainian CLP Regulation and Revisions to the List of Products for Market Surveillance
SGS publishes SafeGuardS summarizing Ukraine’s new technical regulation for the classification, labeling and packaging of substances and mixtures and updates to the list of goods for market surveillance.
- (1888PressRelease) June 07, 2024 - SGS, the world’s leading testing, inspection and certification company, published SafeGuardS 082.24 summarizing recent changes to Ukraine’s regulations governing the classification, labeling and packaging of substance and mixtures.
Resolution No. 539/2024 ‘On Approval of the Technical Regulation for the Classification of Hazards, Labeling and Packaging of Chemical Products’ was issued by the Ukrainian Cabinet of Ministers on May 15, 2024. This is modeled on the EU’s Regulation (EC) No. 1272/2008 ‘Classification, Labeling and Packaging of Substances and Mixtures’, CLP Regulation, which implements United Nation’s Globally Harmonized System of Classification and Labeling of Chemicals (GHS).
Article 1(49) of the Law of Ukraine No. 2804-IX of December 2022 ‘On Ensuring Chemical Safety and Management of Chemical Products’ defines the term ‘chemical products’ as chemical substances, mixtures, alloys and products, during the use of which there is deliberate release of chemical substances, or which are manufactured to carry out explosive works or create a pyrotechnic effect.
The resolution also adds ‘Item 71 Chemical products’ to the list of products that are subject to market surveillance activities under Resolution 1069/2016. This list contains a wide variety of goods and the name of the regulatory act to which they are obliged to comply with, for example, electrical and electronic equipment (EEE) – Resolution of the Cabinet of Ministers of Ukraine dated March 10, 2017 No. 139 ‘On approval of the Technical Regulation on the restriction of the use of certain hazardous substances in electrical and electronic equipment’.
