SGS Publishes Helpful Overview of New EU Restrictions on Lead in PVC

SGS publishes SafeGuardS looking at new EU restrictions on lead and its compounds in PVC under REACH. End Quote

(1888PressRelease) May 23, 2023 - SGS, the world’s leading testing, inspection and certification company, has published SafeGuardS 055.23 to help stakeholders understand the European Union’s (EU) expansion in lead restrictions to include PVC articles.

Issued on May 8, 2023, Regulation (EU) 2023/923 amends the restriction on lead and its compounds to less that 0.1% in PVC polymer and copolymer articles. The update affects entry 63 to Annex XVII of Regulation (EC) No. 1907/2006 ‘Registration, Evaluation, Authorization and Restriction of Chemicals’ (REACH).

There are several derogations, including:
• PVC articles containing recovered flexible PVC allowed until May 28, 2025
• May 28, 2033 – applies to PVC-silica separators in lead acid batteries
• Suppliers of PVC articles containing recovered rigid PVC with 0.1% or more of lead authorized to provide the statement ‘Contains ≥ 0.1% lead’ on the article – this statement may be placed on the article packaging if is not possible on the article
• Articles are exempted if they are within the scope of:
• Regulation (EC) No.1935/2004 ‘Food contact materials and articles’
• Directive 94/62/EC ‘Packaging and packaging waste’
• Directive 2009/48/EC ‘Toys’
• Directive 2011/65/EU ‘Electrical and electronic equipment (RoHS recast)

The new restrictions will come into effect on November 29, 2024.
