The article discussed how healthcare organization should appropriately respond when they receive a notice of intent to sue. Since receiving these kinds of notices are a common occurrence for health systems and hospitals, many of these notices are delayed responses or even avoided. However, some states require that the notices be immediately turned over to their insurer to be appointed counsel. According to Buckley, “the first thing to do is to report the notice of intent to your insurance carrier.”
Buckley elaborated, “if you have a claims-made policy, you want to make sure you’re reporting that in a timely fashion. It’s important to lock the EMR (electronic medical record) file to make sure that no one can get into the EMR without authorization. One of the things the plaintiff bar really looks for now is footprints in the audit trail. If they start seeing footprints after the notice of claim, it just raises an eyebrow as to who is in there and what they’re looking for and if they attempted to make subtle changes.”
