Schenck, Price, Smith & King LLP Partner Featured in Flagship Health Publication

- Newark, NJ (1888PressRelease) October 23, 2024 - Deborah A. Cmielewski, Partner at Schenck, Price, Smith & King LLP was featured in a Part B News article where she commented on a HIPAA privacy law.
The article discussed the process of restricting the distribution of patient medical records within the practice. As mentioned in the article, a case in Charlotte, North Carolina revealed a patient had requested a “sensitive issue” be restricted from a specific member working in the practice, to which the answer should have been “yes.” However, the patient was later made aware that the request was not honored and was assessed by this specific individual “without a legitimate reason.”
With over 20 years of experience advising and counseling health care providers, Cmielewski brought a different perspective to this situation. The clinic might have discovered that denying the staff member access could have had a negative impact on the patient's care. According to Cmielewski, there can also be employment law implications if denying someone access prevents from being able to carry out their job duties.
“Certainly, the analysis will vary depending upon whether you are dealing with an administrative employee versus a medical provider, and there could be both federal and state implications,” Cmielewski continued. “If Jane Doe is the only biller in a medical practice and without Jane Doe having access to my records the practice cannot bill my insurance company for my visit, there’s going to be a problem on several different levels.”
