  • Durham, NC (1888PressRelease) May 11, 2016 - An almost 100-page bill was released last year to introduce Personal Care Products Safety Act. This bill is to significantly expand the authority of FDA over cosmetics products that are sold in US. A variety of issues are discussed in the bill, including registration of facilities and products, adverse and serious adverse reporting, mandatory recall authority etc. Seemingly, FDC Act's existing provisions have been drawn by the bill drafters that are applicable to nonprescription drugs and from certain provisions applicable to foods.

    FDA would only be able to recall its mandatory authority in limited instances where the exposure or use of a cosmetic may likely cause a serious health hazard/death and the company has voluntarily refused to recall the product. If the products are cosmetics and non-prescription drugs, they are subjected to requirements needed for non-prescription drugs as well as cosmetics. If the nonprescription drugs are 'substantially similar' to the proposed law requirements, their compliance will be deemed with new law.

The amendment allows products sold in California with foreign components to make US claims contingent on certain conditions.

    Despite such amendments, organizations are rallying for litigation efforts, and have steep demands to make. They seek a full recall of products with USA claim in last four years, want a full refund of purchasing price for consumers and also want companies to conduct an advertising campaign. Though this bill is not the first providing FDA with additional authority, it certainly is the most comprehensive.
