Phenol Restricted Under European Toy Safety Directive

  • (1888PressRelease) May 18, 2017 - The European Union (EU) has published new restrictions on the use of phenol (CAS 108-95-2) in toys falling under Appendix C of Annex II in Directive 2009/48/EC, the so-called European Toy Safety Directive (TSD). Issued on May 4, 2017, Directive (EU) 2017/774 establishes two sets of limits for phenol:

    • No more than 5 mg/L for migration from polymeric materials
    • No more than 10 mg/kg for content when used as a preservative

    These restrictions apply to toys for children aged less than 36 months, and other toys intended to be placed in the mouth.

    In toys, phenol is used as:

    • An antioxidant in polymers
    • A monomer for phenolic resins in the manufacture of resin-bonded wood
    • A preservative in toys containing water (water-based liquid toys) such as bubble-blowing products and felt-tipped marker pens

    Phenol is listed as a mutagenic category 2 substance. Proposals to restrict phenol under the TSD were originally circulated in October 2014, among a list of six chemicals. The other five substances were:

    • 1,2-Benzisothiazol- 3(2H)-one
    • 5-Chloro-2-methylisothiazolin-3(2H)-one
    • 5-Chloro-2-methylisothiazolin-3(2H)-one (CMI) and 2-methylisothiazolin-3(2H)-one (3:1 mixture)
    • Formamide
    • 2-Methylisothiazolin-3(2H)-one

    Following this, restrictions for these five chemicals were published in November 2015 and will be implemented in two phases, beginning on May 24, 2017.

    After the publishing of Directive (EU) 2017/774 on May 4, 2017, the restrictions relating to phenol will become effective on November 4, 2018.
