New PFAS Ban for Food Contact Paper and Paperboard Proposed in Denmark

Denmark has announced the intention to ban the use of PFAS chemicals in food contact paper and paperboard materials and articles. End Quote

(1888PressRelease) October 25, 2019 - Denmark’s Ministry of Environment and Food has announced it intends to prohibit the use of perfluoroalkyl and polyfluoroalkyl substances (PFAS, also known as PFAS chemicals) in food contact paper and paperboard materials and articles.

The announcement was made on September 2, 2019, the same day as the Danish Veterinary and Food Administration launched a public consultation over a draft Ordinance on food contact materials and penalties in violation of EU-related legislation. The consultation was completed on September 22, 2019.

The draft Ordinance includes several important changes, including the:
• Addition of a definition for paper and paperboard
• Inclusion of a ban on PFAS chemicals in food contact paper and paperboard materials – they are allowed if there is a functional barrier in the product to avoid migration into food
• Inclusion of a transitional provision for food contact paper and paperboard materials and articles that are placed on the market before the effective date

The draft Ordinance defines paper and paperboard as made of cellulose-based natural fibers from virgin and recycled sources. They may contain artificial fibers, functional additives and other agents, binders, plastic films, ink, varnishes, coatings and glue.

If adopted, the new legislation will not apply to the use of PFAS chemicals in food contact paper and paperboard materials and articles when they provide a functional barrier to prevent the migration of substances into food. Stakeholders should also be aware food contact paper and paperboard materials and articles placed on the market before July 1, 2020, and which meet the general requirements in Regulation (EC) 1935/2004, can remain on the market until stocks are exhausted

If accepted, the draft Ordinance will repeal Ordinance No. 1248 of October 30, 2018, on food contact materials. It is proposed the prohibition will come into effect on July 1, 2020.
