New Paint Lead Restrictions in Georgia

  • (1888PressRelease) May 13, 2021 - The Government of Georgia has issued a new technical regulation restricting lead in paints/varnishes used in construction.

    Published on April 5, 2021, Resolution No. 148 of April 2, 2021 – ’On Approving the Technical Regulation on Lead Content in Paints’ – contains several important provisions, including:

    • Importers are required to submit an ‘advance notice on the import of paints/varnishes’ electronically via the website of the LEPL Revenue Service (Revenue Service) to the Revenue Service and the Market Surveillance Agency (the Agency) – the rules for filing will be determined by the Minister of Finance and Minister of Economy and Sustainable Development by July 1, 2023
    • Agency authorized to sample products in the Customs Control Zone for testing
    • Agency authorized to carry out documentary requirements no later than three working days after registration of ‘advance notice on the import of paints/varnishes’
    • Lead and its compounds restricted to no more than 90 mg/kg (0.009%)
    • Manufacturers and importers must retain documentation for 10 years after placing paints/varnishes onto the market

    The Technical Regulation also includes some exemptions, a list of HS codes for products that are within scope, and designated ISO and ASTM methods for sampling and analysis. To see a list of HS codes view SGS’s original SafeGuard 053/21.

    Exemptions include paints used in the restoration of:
    • Ancient architectural monuments
    • Works of art
    • Vehicles designated as objects of cultural and historical heritage

    However, there must be warning phrases on the product label.

    Stakeholders should be aware this Technical Regulation will come into effect on July 1, 2023.
