- Chicago, IL (1888PressRelease) January 12, 2022 - Ed Rice obtained a fee-shifting order in a declaratory judgment patent lawsuit filed in federal district court against Ed’s client, Nano Gas Technologies, Inc. Marina Saito of Miller Canfield Paddock and Stone, P.L.C. assisted Ed in the case. After winning the case on a threshold motion to dismiss in 2021, the team moved for attorney fees under section 285 of the patent statute. The district court initially deferred its ruling, pending the competitor’s appeal. Ed argued the appeal in September and won an order that summarily affirmed the dismissal. Ed then moved to supplement the fee motion to include attorney fees for the appeal. On January 5, 2022, the district court granted the motion and ordered the competitor to pay Nano Gas’s attorney fees and costs for both the district court action and the appeal, finding that the competitor not only had pursued a meritless case and appeal, but also had “repeatedly used the Court system” in an effort to “unwind or undermine” the rights that the competitor’s predecessor-in-interest had assigned to Nano Gas.
