Abstract
Recent trends for malpractice concerns and PTO disciplinary actions leave patent practitioners at risk. With the recent trends and developments, firms that consider intellectual property rights as one of their most significant and valuable assets are ensuring protection against claims and other legal risks. However, the complexities and intricacies of the patent prosecution process have escalated the chances for unprecedented errors.
Thus, in order to mitigate risks and pitfalls of patent prosecution malpractice claims and PTO discipline, the development and implementation of an effective defense strategy against such claims and discipline are of utmost importance.
Listen as Mr. Michael Messina, patent attorney and principal in the law firm of Miles & Stockbridge P.C., provides the audience with an in-depth analysis of the current patent prosecution malpractice and PTO disciplinary landscape. The speaker will also offer helpful insights on how to effectively mitigate risks and perils.
In a LIVE webcast, the speaker will discuss:
- What are the major categories of malpractice risks for patent lawyers versus lawyers in general?
- What are the most common behaviors/pitfalls that lead patent lawyers into these malpractice risks?
- How can the US PTO’s Rules of Professional Conduct (37 CFR 11.101 et seq.) and the changing emphasis of PTO’s Office of Enrollment and Discipline (OED) raise the risk of malpractice and suspension/disbarment?
- What can patent practitioners do to avoid malpractice and/or OED discipline in 2019?
