Manufacturers of Food Contact Materials Warned About New EU Market Surveillance Plans
The EU has announced details of its latest market surveillance program looking at substance migration from food contact materials and products. The survey will run from June 1 to December 31, 2019.
- (1888PressRelease) June 13, 2019 - On May 17, 2019, the European Union (EU) published Recommendation (EU) 2019/794 – a coordinated control plan to evaluate the safety and compliance of food contact materials.
Recommendation (EU) 2019/794 introduces a market surveillance strategy to assess the prevalence of certain substances migrating from food contact products and materials. In the coming months, this strategy will survey a large number of chemicals and products to assess food safety compliance as per Regulation (EC) 1935/2004 for food contact material safety requirements, Regulation (EU) 10/2011 for plastic materials, and various other applicable documents.
Substances to be tested for include primary aromatic amines (PAA), formaldehyde and melamine, phthalates and non-phthalate plasticizers, bisphenol A and S (BPA & BPS), phenol, metals and fluorinated compounds. The food contact materials and products to be sampled include plastic tableware and kitchenware, reusable plastic cups using bamboo derivatives, printed paper and cardboard packaging, polycarbonate plastic (BPA) and polyethersulfone plastic (BPS), and coated metal packaging (e.g. cans, lids). Surveillance must use a minimum of 1,650 samples.
For more information on which requirements will be considered in this market surveillance initiative, stakeholders are advised to read “Actions and Scope of the coordinated control plan”, an Annex to Recommendation (EU) 2019/794.
The plan also details the countries involved and the recommended minimum number of samples each must produce:
• 100 samples - Belgium, Germany, Spain, France, Italy, United Kingdom
• 75 samples - Czechia, Cyprus, Hungary, Netherlands, Poland, Romania
• 50 samples - Denmark, Ireland, Greece, Croatia, Lithuania, Austria, Portugal, Sweden
• 25 samples - Bulgaria, Estonia, Latvia, Luxembourg, Malta, Slovenia, Slovakia, Finland
The survey will take place between June 1 and December 31, 2019. The results of the market surveillance will be made available to the European Commission by February 29, 2019.
