In the article, Scola discussed the impact predictive analysis has on the patent process. The fast-paced increase in patent innovations task intellectual property attorneys with additional challenges in devising strategic protection plans. The balance of disclosing sufficient information to obtain protection, while avoiding over-disclosure becomes paramount.
Scola described the situation as one that frequently arises in the pharmaceutical industry in New Jersey. Companies in that industry might only have one chemical. However, they can project numerous findings from early studies, including possible new medications, thanks to their advanced technologies.
Scola further detailed that businesses aim to maximize the value of their research. However, he believes that the kinds of safeguards that businesses can obtain through intellectual property claims are being slowly reduced, particularly in the biopharma space. The responsibility is now greater on patent applicants to obtain more data to support the range of protections they desire.
Scola stated, “The way to adjust to it is to not disclose more than you can actually support, and to save that extra portion for when you have data to support it.” Scola believes that this often can result a basic unfairness to patentees.
He further elaborated, “It’s sometimes best to hold back on including certain information in an original patent application. What you should disclose on those applications is a judgment call, because you do want to disclose enough to get good coverage.”
