In the later part of 2017, the U.S. Court of Appeals for the Federal Circuit has held that the TC Heartland v. Kraft Foods decision of the Supreme Court changed the patent venue landscape. An alleged infringer may now argue of improper venue “in a judicial district where it is subject to a court’s personal jurisdiction but where it is not incorporated and has no regular and established place of business.” The venue decision is becoming much more complicated as a result of recent decisions.
In determining patent venue, litigants should consider the chosen forum’s treatment of patent venue issue and its position on burden.
