Abstract
In the wake of the U.S. Supreme Court decision in Alice Corp. v. CLS Bank International, the United States Patent and Trademark Office (USPTO) recently released a revised guidance for subject matter eligibility under 35 U.S.C. § 101. The new guidance, which intends “to improve the clarity, consistency and predictability of actions across the USPTO", provides a list of abstract concepts to define what composes an abstract idea. Due to its more "pro-patent" tone, an increase in the approval rates of patent applications is expected.
As the patent landscape continues to evolve, patent eligibility under § 101 becomes more nuanced. Thus, it is essential for companies and their counsel to keep themselves updated of the most recent guidance and case law relevant to the evaluation of patent eligibility.
