Event Summary:
Several recent cases have provided guidance on what courts will accept in the calculation of reasonable royalties. In Summit 6, LLC v. Samsung Electronics Co., Ltd., the CAFC accepted a valuation of a patented feature based upon the frequency with which the product was used. In VirnetX v. Apple the CAFC stated that apportionment may be needed below the level of the "smallest salable unit," when multiple patents or technologies read on that unit. Ericsson v. D-Link addressed issues of "royalty stacking" and the need to attribute to a standard essential patent only the incremental benefits of the technology described in the patent, excluding the value of the standard itself. CSIRO v. Cisco provides guidance on the use of real-world comparable licenses in determining a reasonable royalty and the appropriate royalty base.

About Kim Schenk
Ms. Kimberly Schenk has worked on intellectual property litigation in a wide variety of industries, including telecommunications, pharmaceuticals, and biological products, among others. Her experience has included the determination of lost profits and reasonable royalty damages, prejudgment interest, and commercial success. Additionally, Ms. Schenk has extensive experience in assisting clients with generating and organizing evidence in all phases of the litigation process and has assisted clients in the negotiation of license agreements in a variety of contexts. Ms. Schenk has testified as an expert witness in cases in Federal and State Court.
In addition to her experience in intellectual property matters, Ms. Schenk has performed damages assessments for a variety of other types of business disputes, including breach of contract litigation and false marking. She has also been involved in valuations of privately held businesses, patents and patent portfolios, trademarks, non-competition agreements, and other intangible assets.
