About Joel Wacek
Joel Wacek is a Principal of Hoffman Alvary. His practice focuses on financial and economic analysis for intellectual property disputes, licensing and business valuation matters. Mr. Wacek has more than a decade of experience in computing damages in intellectual property infringement matters, as well as providing financial analysis related to breach of contract and business valuation disputes.

As the number of cases filed under patent infringement continues to grow, methods in determining related damages have significantly evolved as well. In a recent case involving Exmark Manufacturing Company and Briggs & Stratton Power Products, the U.S. Court of Appeals for the Federal Circuit affirmed that reasonable royalty calculations have important implications in patent infringement. The jury trial between the U.S.-based companies has found that the defendant infringed the contested patent, and thus, awarded the plaintiff with over $24 million in damages.
Given the outcomes in Exmark, the Federal Circuit has signaled greater flexibility when apportioning damages by allowing the use of royalty rate in addition to the royalty base when valuing a patented invention's contribution to a larger multicomponent product.
