International mediation in Uzbekistan: the Florence approach
New promising step in developing the non-judicial dispute resolution in Uzbekistan.
- (1888PressRelease) August 07, 2020 - The Tashkent International Arbitration Center (TIAC) at the Chamber of Commerce and Industry of the Republic of Uzbekistan, in cooperation with the Florence International Mediation Chamber (FIMC) and the Law Reform Program of the US Agency for International Development (USAID), will develop a separate set of Rules for the resolution of international commercial and investment disputes by means of mediation (hereinafter - the "Rules" ).
Since the entry into force of the Law of the Republic of Uzbekistan "On Mediation" in 2019, Uzbekistan has taken resolute steps to introduce mediation into the national judicial dispute resolution system and is currently considering the possibility of joining the Singapore Convention.
TIAC being established in 2018 has become the first Uzbek arbitration center authorized to consider disputes with an international element and to apply foreign law. In addition to resolving disputes by means of arbitration, TIAC is intended to become a central forum for the settlement of disputes between international commercial corporations and investors through mediation.
Since its foundation in 2015, FIMC managed to become a pillar of international mediation in Italy within a one year. The FIMC's experience in dispute administration is extremely important both in terms of their approach to the selection and appointment of mediators, and the organization of mediation hearings, not excluding the importance of the experience of Italian jurisdiction in the resolution of international mediation disputes.
The development of the Rules became possible especially after the signing of a bilateral memorandum of understanding between FIMC and TIAC, which will further facilitate the implementation and application of the Rules.
Trade and investment cooperation between Uzbekistan and Italy is developing very rapidly, which contributed to an increase in the balance of Italian investments in Uzbekistan by 54% in 2019 (EUR 29.9 million) and confirms the strengthening relationship between Uzbekistan and Italy.
The Rules will contribute to the development of a system of non-judicial dispute resolution with the possibility of attracting highly qualified international mediators.
