Further Changes to EU Proposals on BPA in Food Contact Materials and Articles
The EU issued two amendments to its proposals for BPA in food contact materials and articles in September 2017. If accepted, the new provisions could become effective in late 2018.
- (1888PressRelease) October 26, 2017 - In September 2017, the European Union (EU) issued two proposals to amend its draft legislation on bisphenol A (BPA) in ‘food contact plastics’ and ‘food contact varnished or coated materials and articles’.
The EU had originally circulated a proposal to alter Regulations (EC) 10/2011, the so-called ‘Food Contact Plastics Regulation’, via the World Trade Organization (WTO) as document number 16-1443, in March 2016. The draft regulation, amended by WTO document number 17-4734 in early September 2017, contained several changes, including:
• Strengthening the migration limit for BPA from 0.6 mg/kg to 0.05 mg/kg
• Expanding the proposed migration limit of 0.05 mg/kg for BPA to food contact varnished or coated materials and articles
• Requiring a declaration of conformity (DoC) for food contact varnished or coated materials and articles
• Prohibiting BPA migration in food contact plastics and food contact varnished or coated materials and articles intended for infants and young children for food categories falling under Regulation (EU) 609/2013
A second amendment, circulated by the WTO in late September 2017 as document number 17-5152, makes one further amendment to the proposal. It seeks to extend the prohibition of BPA in polycarbonate (PC) infant feeding bottles to PC drinking cups and/or bottles (sippy cups) intended for infants and young children.
The law contains a provision for products that were lawfully placed on the market before the effective date to remain on sale until stocks are exhausted.
The provisions of the new law will come into effect six months after their entry into force. This could mean the new law is effective in late 2018.
