Fox Capital Partners - Deadlock Persists In Sustainable Energy IPO
Fox Capital Partners says it is "making progress" on breaking a week-long deadlock in negotiations with key executives and financial stakeholders in an as-yet-unnamed sustainable energy company over the terms of a potential initial public offering.

"This could be a bigger sticking point than we'd initially imagined," said Ollie Seigler, head of energy research at Fox Capital Partners. "They're digging in their heels and being quite truculent despite our best efforts to reach a middle ground including shortening the lock up period they had such strong objections to."
The startup's principals are not willing to negotiate on the type of stock its financial backers will receive for their consideration but it has shown willingness to compromise on lock up periods.
"They offered exactly what the backer demanded in terms of lock up period - namely, no more than 6 months - but only want to offer preference shares to their so-called "tier 1" stakeholders," said Johann Vries, Fox Capital Partners' lead negotiator who also leads equity sales operations at the firm.
"Still, we've made some progress and hopefully, by this time next week, we'll have laid the groundwork for further progress," Vries added.
Fox Capital Partners says it is floating the possibility of listing the startup's stock on Hong Kong's Hang Seng Exchange if the ban on IPOs on China's mainland indices shows little sign of being lifted by the end of the first quarter of 2016.
"We and they would prefer Shanghai or Shenzhen but much of the say lies with the backers," noted Vries.
