EU Revises SVHC Candidate List Under REACH

  • (1888PressRelease) February 11, 2022 - SGS, the world’s leading testing, inspection and certification company, is reminding manufacturers of consumer products that ECHA – the European Chemical Agency – has amended the Candidate List under REACH.

    Firstly, ECHA has added four SVHCs – substance of very high concern:
    1. 6,6'-Di-tert-butyl-2,2'-methylenedi-p-cresol (DBMC)
    2. Tris(2-methoxyethoxy)vinylsilane – hydrolyses rapidly when in contact with water or air moisture to release 2-methoxyethanol, which is also a SVHC on the Candidate list added in 2010
    3. (±)-1,7,7-Trimethyl-3-[(4-methylphenyl)methylene]bicyclo[2.2.1]heptan-2-one covering any of the individual isomers and/or combinations thereof (4-methylbenzylidene camphor, 4-MBC)
    4. S-(Tricyclo[5.2.1.0'2,6]deca-3-en-8(or 9)-yl) O-(isopropyl or isobutyl or 2-ethylhexyl) O-(isopropyl or isobutyl or 2-ethylhexyl) phosphorodithioate

    Entries 1 and 2 are categorized as toxic to reproduction category 1B. Uses for these substances include the product of tires, sealants, polymers, rubber and plastics, inks and adhesives. Entry 3 is categorized as endocrine disrupting and it is used as a UV filter in cosmetics. Entry 4 is categorized as persistent, bioaccumulative and toxic and it is used in lubricants and greases.

    Secondly, ECHA has also revised an earlier entry. Group entry “Nonadecafluorodecanoic acid (PFDA) and its sodium and ammonium salts” previously included two entries: “Decanoic acid, nonadecafluoro-, sodium salt” and “sodium nonadecafluorodecanoate.” “Decanoic acid, nonadecafluoro-, sodium salt” has now been removed from the list because the two names describe the same substance and are equivalent.

    Under Article 33 of REACH, manufacturers and importers operating within the European Union (EU) and European Economic Area (EEA) must provide information to allow the safe use of a product that contains concentrations of an SVHC in excess of 0.1% (w/w). This must be supplied to recipients upon supply and consumers within 45 days of a request. If an article contains an SVHC with a concentration above 0.1%, and with a quantity over one metric tonne per year, the manufacturer or importer must notify the ECHA under Article 7 of REACH.

    Notification of SVHCs within an article must be made within six months of their inclusion on the Candidate List. These four substances were added on January 17, 2022, and so the deadline for notification is July 17, 2022.

    Stakeholders are reminded that since January 5, 2021, EU producers, importers, assemblers and distributers of articles containing SVHC concentrations above 0.1% (w/w) must submit a notification to the Substances of Concern In articles as such or in complex objects (Products) (SCIP) database under the Waste Framework Directive (WFD).

    The Candidate List now contains 233 entries.
