EU Publishes Guideline to Help Companies Comply with Regulation (EU) 2018/1513

  • (1888PressRelease) January 17, 2019 - The European Commission has published an explanatory guide that clarifies the scope of the recently issued Regulation (EU) 2018/1513. This regulation covers 33 carcinogenic, mutagenic or reprotoxic (CMR) category 1A or 1B substances. These are included in a new entry 72 to Annex XVII of REACH. The guidelines also include a non-exhaustive list of examples to show what products are deemed to fall under the scope of the regulation.

    Regulation (EU) 2018/1513 applies to:
    • Clothing or related accessories
    • Footwear
    • Textiles other than clothing which, under normal or reasonably foreseeable conditions of use, come into contact with human skin to an extent similar to clothing

    While clothing, accessories and footwear are self-explanatory, the guidelines do give several examples relating to ‘textiles other than clothing’. These include:
    • Bath robes, bed linen, blankets
    • Cushion covers
    • Sleeping bags
    • Towels
    • Upholstery (fabric covering chairs, armchairs, and sofas etc.)

    It should also be considered that plush toys will also fall under the scope of the regulation as these can be hugged next to the skin for long periods.

    The guidelines make it clear that where different concentration limits for these 33 CMR substances exist in other entries of Annex XVII to REACH, or in other pieces of EU legislation, the strictest limit will apply. It should also be noted that CMR are banned in toys by the Toy Safety Directive, Directive 2009/48/EC.

    The guideline gives a list of available methods in certain matrixes that can be used for the determination of the different CMR substances. It also suggests the most effective methods, as some may require adaptions. Stakeholders should note the suggested method for benzene is actually for benzene emissions.

    Regulation (EU) 2018/1513 will come into effect on November 1, 2020.
