EU Introduces Restrictions on Peanut Oil, its Extracts and Derivatives and Hydrolyzed Wheat Protein

  • (1888PressRelease) January 09, 2018 - On December 4, 2017, the European Commission published Regulation (EU) 2017/2228, restricting the use of peanut oil (arachis hypogaea oil), its extracts and derivatives, and hydrolyzed wheat protein. The new regulation entered into force on December 25, 2017.

    The regulation covering peanut oil (and its extracts and derivative), contained within Annex III entry 306, requires the restriction of peanut proteins to a maximum concentration of 0.5ppm. This rule covers several common ingredients, including:
    • Arachis hypogaea oil
    • Arachis hypogaea seedcoat extract
    • Arachis hypogaea flour
    • Arachis hypogaea fruit extract
    • Arachis hypogaea sprout extract
    • Hydrogenated peanut oil
    • Peanut acid
    • Peanut glycerides
    • Peanut oil PEG-6 esters
    • Peanutamide MEA
    • Peanutamide MIPA
    • Potassium peanutate
    • Sodium peanutamphoacetate
    • Sodium peanutate
    • Sulfated peanut oil

    The regulation regarding hydrolyzed wheat protein, contained within Annex III entry 307, allows a maximum molecular weight average of the peptides in hydrolysates of 3.5kDa.

    These changes follow the opinions – SCCS/1526/14 and SCCS/1534/14 – of the Scientific Committee on Consumer Safety (SCCS).

    Stakeholders should be aware that:
    • From September 25, 2018: only cosmetic products that comply with the Regulation may be placed on the EU market
    • From December 25, 2018: only cosmetic products that comply with the Regulation may be made available on the EU market

    Stakeholders are therefore advised to check their products comply with the latest European Union regulations and phase out any non-compliant ingredients by the compliance dates.
