EU Introduces Restrictions on Deca-BDE under REACH
On February 10, 2017, the EU published legislation restricting Deca-BDE under Annex XVII of REACH. The provisions to restrict this substance will come into force on March 2, 2019.
- (1888PressRelease) March 03, 2017 - The European Union (EU) has recently instigated measures to regulate decabromodiphenyl ether (Deca-BDE), also known as bis(pentabromophenyl) ether. Under the new rules, Deca-BDE with be prohibited as a substance and restricted to a maximum of 0.1% in articles, mixtures, or as a constituent of substances.
Deca-BDE is widely used as a flame retardant in plastic and textile articles, as well as in adhesives, coatings, inks and sealants. It has been included on the Candidate List of substances of very high concern (SVHCs) since December 2012.
Published on February 10, 2017, Regulation (EU) 2017/227 creates a completely new entry 67 to Annex XVII of REACH. The new legislation contains several exemptions, including:
• Articles placed on the market before March 2, 2019
• Electrical and electronic equipment (EEE) falling under Rohs II (Directive 2011/65/EU)
• Spare parts for vehicles (Directive 2007/46/EC) or machineries (Directive 2006/42/EC) that are manufactured before March 2, 2019
• The manufacture of aircraft, or their spare parts, before March 2, 2027
The new regulations will come into effect on March 2, 2019, and so stakeholders are now advised to check their product's compliance with the new law.
