EU Adds Over 200 Prohibited Substances n Cosmetics Regulation Update
The EU has updated its regulation for cosmetics regarding CMR substances. This came into force on June 12, 2019.
- (1888PressRelease) July 12, 2019 - On May 22, 2019, the European Commission amended Cosmetics Regulation (EC) No. 1223/2009 by updating Annexes II, III and V. The new regulation, (EU) 2019/831, updated the annexes in regard to substances classified as carcinogenic, mutagenic and reprotoxic (CMR) categories 1A, 1B or 2 under Regulation (EC) No. 1272/2008 as at December 1, 2018.
The amendments include the inclusion of over 200 entries to Annex II for prohibited substances, and it came into force on June 12, 2019.
Prohibited substances include:
Quaternium-15
Chloracetamide
Dichloromethane
Formaldehyde
Perboric acid and Sodium perborate compounds
Boron compounds (originally listed in entries 1a and 1b of Annex III)
Dibutyltin hydrogen borate
Paraformaldehyde
Methylene Glycol
Trimethylbenzoyl diphenylphosphine oxide (TPO)
Furfural
Polyaminopropyl Biguanide

Stakeholders should be aware a CMR category 2 can be used in cosmetic products if the substance has been evaluated by the Scientific Committee on Consumer Safety (SCCS) and has been found to be safe for use in cosmetic products. CMR category 1A or 1B substances are prohibited in cosmetic products, unless they meet several conditions laid down in paragraph 2 of Article 15(2) for exemptions.
Stakeholders in the EU cosmetics market are advised to review the additional substances added to Annex II and modify their products accordingly to remain compliant.
