About Eliana Garces
Dr. Eliana Garcés is an economist with broad experience in antitrust enforcement and regulatory design. She was in the cabinet of Vice President Joaquín Almunia, the European Commissioner responsible for competition policy in 2010-2014. In that position she supervised antitrust and merger investigations in financial services, information technology, telecommunications, and energy markets.
Previous to joining The Brattle Group, Dr. Garcés was the Deputy Chief Economist in the European Commission’s Directorate General for Internal Market and Industry where she provided analyses relevant to policy issues involving investment and industrial competitiveness. She also served as a member of the Competition Chief Economist Team. Dr. Garcés has held positions in both government and the private sector, including previous economic consulting experience in the United States. She has spoken in numerous events including the Global Competition Review conferences, the Fordham Competition Law Institute, the American Antitrust Institute or Jevons Institute for Competition Law.

International efforts and heightened enforcement actions that address legal issues surrounding Standard Essential Patents (SEPs) are continuously taking place as SEPs remain to be one of the most debated topic in the antitrust industry. Just recently, as part of the new Antitrust Guidelines, the U.S Department of Justice (DOJ) and the Federal Trade Commission (FTC) specifically stated that licensing of SEPs should be covered by the same general principles as other patent licensing. In contrast, the EU commission has published its communication that sets out a general, non-binding framework on their approach to SEPs. Similar efforts to implement a standard that is aimed at protecting patented technologies, are also seen in other developing countries.
