Abstract
Important developments and issues surrounding fair, reasonable, and non-discriminatory (FRAND) licensing and standard essential patents (SEPs) continue to persist and become burden to businesses and patent holders. Among the most notable updates the TCL v. Ericsson case’s remand from the Federal Circuit; and recent U.S. decisions (FTC v. Qualcomm and Continental v. Avanci) and the referral to the CJEU (Nokia v. Daimler) regarding refusal to license SEPs at the component level is an antitrust violation. Thus, all concerned professionals and practitioners should keep abreast of the current and emerging trends in the SEPs and FRAND litigation to avoid risks and pitfalls. It is also vital for companies to evaluate their existing strategies to devise new ones.
