City Council Introduces Stormwater Ordinance

- Nassau-Suffolk, NY (1888PressRelease) May 01, 2018 - An ordinance to manage stormwater has been introduced by New Castle city council, in Delaware.
The ordinance proposes imposing a $72 per year user fee to be paid by residents of single-family detached dwellings.
Developed properties within city limits will pay fees based on the number of square feet of impervious surfaces on their property as determined through aerial photography. These property owners will pay up to $15,000 per year.
Public streets, although impervious surfaces, are exempt from user fees.
The ordinance also authorizes city officials to impose fees to maintain the stormwater system, and the New Castle Sanitation Authority to collect the fees.
The proposed ordinance states the user fees are fair and equitable charges to assure that each lot, developed parcel, building and service recipient within city limits will pay a proportionate share of the costs to operate, maintain, repair, regulate and comply with the stormwater management system as well as pay for administration, replacement and improvements for the system. The charge are based on are a reasonable standard fee per residential unit that measures impervious surfaces
A public stormwater system, the ordinance notes is fundamental to the public health, safety, welfare and protection of residents and their property and necessary to control flooding, erosion and pollution. It adds that federal and state regulations require the city to implement and maintain a program of stormwater control.
According to the ordinance,the system includes underground pipes, conduits, inlets, culverts, catch basins, dams, flood control structures, gutters, ditches, detention ponds public streets, curbs, conveyances, drains and management practices.
