China Publishes RoHS 2 Catalogue and Exemption List

  • (1888PressRelease) April 25, 2018 - China’s Ministry of Industry and Information Technology (MIIT) has released two documents under its requirement of the restriction of hazardous substances (RoHS 2). The two documents are:

    • The Standard Achieving Management Catalogue for the Restriction of Hazardous Substances in Electrical Appliances and Electronic Products (The First Batch)
    • Exemption List for the Restriction of Hazardous Substances of the Standard Achieving Management Catalogue

    The first document covers the twelve types of product (the first batch), including their scope, definition and explanations on the scope of the application. The product types are:

    1. Refrigerators
    2. Air conditioners
    3. Washing machines
    4. Electric water heaters
    5. Printers
    6. Copiers
    7. Fax machines
    8. TVs
    9. Monitors
    10. Micro-computers
    11. Handheld phones for mobile communication
    12. Telephone sets

    The content of lead, mercury, cadmium, hexavalent chromium, polybrominated biphenyls, and polybrominated diphenyl ethers in the products listed in the catalogue must conform to “Rule on the Restriction of Hazardous Substances in Electrical Appliances and Electronic Products” and related standards. Components are also included when they are sold separately and the use is not clear. It is the finished product that defines the applicability of the catalogue, so, if a product is a component of a product not in the catalogue, it will not be in the catalogue.

    An exemption list has also been created for situations where RoHS compliance is technically or economically not feasible. This includes 39 exemptions, including all the exemptions in Annex III of EU RoHS 2, 39(a) in amending directive (EU) 2017/1975 and also those expired by March 2018.

    China’s RoHS 2 differs from the European version in that its exemption list is grouped around the six hazardous substances, with most not having expiration dates. Stakeholders should be aware the exemption list will be only applicable to the products in the catalogue during the conformity assessment.

    Currently, regulated electrical and electronic products must meet the requirements of step one of China RoHS 2 – to provide a proper label to assist consumers and recycling factories to identify information about restricted substances in the products according to SJ/T 11364-2014 (Marking for the Restriction of the Use of Hazardous Substances in Electrical and Electronic Product). The two labels are:

    • Green with a ‘e’ – environmentally-friendly and can be recycled
    • Orange with a number – contains a hazardous substance. It can be used safely during its environmental protection use period (EPUP) (as indicated by the number in the center) and should enter into the recycling system after the EPUP. Manufacturers and importers must provide a declaration table of the hazardous substances according to the standard SJ/T 11364-2014

    Market surveillance performed in 2017 showed that several products failed this test. These included ultrasonic therapeutic apparatus, web cameras, fireplaces and massage bathtubs originating from several countries, including Korea, the US, Japan and Malaysia.

    Stakeholders are advised to check their products comply with the latest standards relating to electrical and electronic equipment in China.
