China Overhauls Cosmetics Industry with Supervision and Administration Regulation

  • (1888PressRelease) August 22, 2020 - After a five year wait, the Chinese Ministry of Justice has approved a new Cosmetic Supervision and Administration Regulation, paving the way for several important changes to the cosmetics industry.

    Significant changes include:
    • Special cosmetics products – cosmetics with a special purpose, see below, will require registration with the National Medical Products Administration (NMPA). Products without a special purpose are termed general cosmetics products. Special cosmetic products include:
    o Hair dye products
    o Anti-hair loss
    o Permanent wave products
    o Skin whitening products
    o Sunscreen
    o Other new function products as determined by NMPA.
    • Toothpaste – not considered to be a cosmetics product but manufacturers and/or suppliers must notify the NMPA before launching a toothpaste product onto the market
    • New cosmetic raw materials that function as a preservative, sunscreen, colorant, hair dye or skin whitener must be registered with the NMPA before use. Other new cosmetic raw materials must also be notified to the NMPA before use
    • Quality control and safety assessment personnel with responsibility for:
    o Safety assessments – must have 5+ years of relevant work experience and possess relevant professional knowledge to the field of cosmetics quality and safety
    o Cosmetic quality and safety – must have 5+ years of relevant work experience and possess relevant professional knowledge in relation to safety control and production management
    • Efficacy claims – the responsible person must upload any research data, literature or abstracts relating to performance testing onto a dedicated website for claim substantiation. This provides the authorities and consumers with easy access to claim materials

    China’s new Cosmetic Supervision and Administration Regulation was approved on July 29, 2020, and it will enter into force on January 1, 2021.

    Stakeholders are advised to check their compliance with the provisions in the new regulation.
