Carter and Carter Solicitors, professional personal injury solicitors in Manchester, have commented on the recent changes to funding for medical negligence cases.
- (1888PressRelease) September 10, 2012 - Stockport, United Kingdom - The Legal Aid, Sentencing & Punishment of Offenders Bill will potentially have a dramatic effect on the way an injured party funds a medical negligence case from April 2012.
An expert from Penningtons LLP has stated that: "The Jackson and Young proposals on costs will raise concerns that those with difficult cases simply will not be able to find funding for their claims and will be denied access to justice and the compensation that they need. Further, if successful claimants end up paying some legal costs out of their damages, this could result in them receiving less in damages than they need to meet their needs. The aim of compensation should be to compensate, not to pay for legal costs."
A spokesperson for Carter and Carter Solicitors said: "Prior to the proposed changes to The Legal Aid, Sentencing & Punishment of Offenders Bill in April 2013, claimants were able to obtain funding for the initial cost of enquiries from the Legal Services Commission, which used to be called Legal Aid. If the proposed changes go ahead then this will no longer be an option, so other ways of funding the initial legal work and the cost of medical records and medical evidence will have to be found. Most firms run these cases on a No Win No Fee basis once they believe there are sufficient prospects of success. Without Legal Aid, firms will have to decide how to fund these initial investigations which are absolutely crucial to see if a Claimant has a chance of winning."
