Canada Proposes Changes to Regulations Prohibiting Certain Toxic Substances

A look at Canada’s proposals to update its regulations relating to the prohibition of certain toxic substances. End Quote

(1888PressRelease) June 10, 2022 - SGS, the world’s leading testing, inspection and certification company, is advising stakeholders that Canada is proposing to update its regulations relating to the prohibition of certain toxic substances.

‘Prohibition of Certain Toxic Substances Regulations, 2022’ was issued on May 14, 2022. If adopted, it will repeal and replace ‘Prohibition of Certain Toxic Substances Regulations, 2012’.

Among the changes proposed in the new regulation are provisions to:
• Expand its scope to include Dechlorane plus (DP) and decabromodiphenyl ethane (DBDPE) and products containing these substances
• Expand the restriction on the manufacture, use, sale and import of the following five substances and products containing these substances:
1. Perfluorooctane sulfonate, its salts and precursors (PFOS)
2. Perfluorooctanoic acid, its salts and precursors (PFOA)
3. Long-chain perfluorocarboxylic acids, their salts and precursors (LC-PFCAs)
4. Hexabromocyclododecane (HBCD)
5. Polybrominated diphenyl ethers (PBDEs)

Stakeholders are advised to review SGS’s original SafeGuardS 069/22 to learn more about these proposals and their requirements.

If accepted, legislative amendments will be made to:
• Regulations Designating Regulatory Provisions for Purposes of Enforcement (Canadian Environmental Protection Act, 1999 (CEPA)
• Export Control List (ECL) of CEPA by including DP, DBDPE, HBCD, LC-PFCAs, PBDEs and PFOA to the ECL – NB. PFOS is currently on the ECL

Stakeholders have until July 28, 2022, to comment on the proposals and until July 13, 2022, to lodge a notice of objection.

The new law will enter into force six months after it is published in the Canada Gazette, Part II.
