BSA Law Advises Construction Companies To Build From A Solid Legal Base, After New EIA Regulations

Construction companies and property investors have been thrown in to disarray after a recent decision to suspend a 2008 government block on construction for projects with an assessed environmental impact. (1888PressRelease) July 29, 2009 - Top Thailand business law experts BSA Law are urging construction companies and project managers to get expert advice before continuing any project, despite a recent decision to allow previously banned construction in certain cases.

A 2008 amendment to Article 67 of the Constitution controlled the building and start-up of manufacturing plants with an assessed environmental impact. The Industry Ministry recently shut down the regulation. Projects under construction with EIA (Environmental Impact Assessment) approval will now be allowed to proceed, while projects without EIA approval will still be suspended.

However, according to an attorney from BSA Law, there will be much more to consider than the new Thailand law for construction companies deciding whether or not to take up tools. "There could be quite large consequences for companies that decide to begin work on the basis of misunderstandings about their EIAs".

"We strongly advise that companies seek Thailand legal advice for their particular situation before taking any action", the attorney continued.

EIAs have been required for all large scale construction projects in Thailand since 1975, by the Enhancement and Conservation of the National Environment Act. However, after calls from Thailand law firms and environmental groups, the law has been in a constant state of review. "This is why we advise waiting until something more concrete than a 'suspension' is enacted", said the attorney.
