Event Synopsis:
In a litigation of underlying cases with limited coverage, the threat of bad faith claims can serve as a solid weapon for plaintiffs when negotiating for higher settlement. The claim must be carefully drafted and supported by relevant documents that can be used as evidence to prove the insurer's wrongdoing. New statutory laws and limitations can be used to limit an insurer’s exposure to bad faith claims.
In this LIVE Webcast, a panel of experienced counsel assembled by The Knowledge Group will discuss in-depth bad faith insurance claims. The panel will also offer litigation tips and best strategies when dealing with bad faith claims from both the policyholder and insurer perspective.
Key topics include:
• Bad Faith Claims – A Legal Primer
• Potential Bad Faith Pitfalls when Dealing with the Duty to Defend
• Strategies for Policyholders to Survive Motions to Dismiss
• Leveraging Pleading Standards in Bad Faith Litigation
• Recent Case Law Updates
