On May 11th of this year, President Obama signed into law the Defend Trade Secret Act (DTSA). The DTSA became effective immediately and is the first federal civil legislation address the protection of trade secrets. The expectation of trade secret owners is that the DTSA will create more uniform protection across the nation. Whether that will occur, and how long it may take before it occurs, is the subject of debate.
What is not debatable, however, is that substantial changes in litigating trade secret disputes are anticipated. The jurisdictional grant of the DTSA will significantly affect the litigation timing and strategy for both plaintiffs and defendants, the jurisdiction for traditional state law claims, and the development of parallel state and federal law for enforcement of trade secret rights.
